Introduction

Axioma Europe Ltd (“Axioma“) provides a platform that facilitates the connection between customers seeking vehicle repair services (“you” or “Client“) and independent repair service providers (“Repairers“). The platform allows customers to request and book vehicle repair services, while Repairers offer their services and provide the repairs. Axioma acts as an agent for the Client in finding a suitable Repairer and contracting with that Repairer on the Client’s behalf. The actual contract for the repair service is between the Client and the Repairer.

By using the Axioma platform (“Platform“), you agree to be bound by these Terms and Conditions. These Terms and Conditions set out your rights and obligations as a Client and govern your use of the Platform. Please read them carefully before using the Platform.

Definitions

  • Repair Services” means any repair (including parts), and inspection services provided by a Repairer under a Booking;
  • Booking Request” means a request from you made by means of the Axioma website, for the supply of Repair Services;
  • Booking” means a contract for the provision of Repair Services entered into between you and the Repairer by means of the Axioma service, with Axioma acting as your agent;
  • Charges” means the charges payable in respect of parts and labour under a Booking;
  • Repairer” means a provider of Repairer Services, independent of Axioma Europe Ltd, which promotes its Services by means of Axioma;
  • Axioma Services” means the Services to be provided by Axioma which are limited to enlisting the services of the Repairer (and related pricing information), entering into Repair Contracts as your agent, and collecting payment.

 

Terms and Conditions for Use of the Platform

Lifetime Warranty on Repairs

    • We require all Repairers to provide Clients with a lifetime warranty on the repairs as set out below in clause 1B.
    • All Repair Services therefore comes with a lifetime warranty on parts and labour provided by the Repairer (“Warranty”). All Repair Services must be free from defects in (i) materials and (ii) workmanship. The maximum amount of liability on the part of a Repairer for any claim under the Warranty shall be limited to the total amount paid for the Repair Service. This limitation applies to any damages, losses, expenses, or costs incurred as a result of the Repair Service, including but not limited to any costs associated with remedying defects, completing incomplete work, or engaging a third-party repair service.

Axioma’s Role and Responsibilities

    • Axioma’s role and responsibility are limited to providing the Axioma Services. We cannot be responsible, and we accept no liability, for the actions or failures of any Repairer with whom a Booking is made, nor any repair (including parts), diagnostic and inspection services they provide. To the extent permitted by law we shall not be liable to you for any losses arising out of, or relating to the Axioma Services.
    • The Repairers are not our employees or workers. We have no involvement in the provision of the Repair Services.

Contract Formation and Payment

    • By accepting our quote, you are entering into an agreement with Axioma for the Axioma Services and authorising Axioma to act as your agent in relation to a Booking for the Repair Services described in that quote Acceptance of the quote authorizes Axioma to keep your card on file until the repair is carried out and to charge your card for payment of the Charges, unless you notify Axioma that you are not satisfied with the repair. Our consideration for the Axioma Services is incorporated into the price stated in the quote.
    • Your contract with the Repairer (being the Booking) is formed when the Repairer confirms acceptance of the job details through the Platform. We will confirm when this has happened and provide details of the Repairer, who will then be in touch directly with you to arrange a time to carry out the Repair Services.
    • Billing will be handled by Axioma through credit (debit) card / Paypal or Bank Transfer.

Obligations of Axioma

    • Axioma is responsible for arranging bookings and collecting payments.
    • Axioma will provide regular updates on the status of the repairs being carried out by the Repairer to the Client, including proactively notifying the Client of any delays
    • Axioma will make reasonable efforts to find a suitable Repairer for the Client at the agreed-upon price. However, Axioma cannot guarantee that a Repairer will be available or willing to provide Repair Services at the specified price. In the unlikely event that a Repairer is not available to provide the Repair Services at the specified price, we will provide an alternative price for the Repair Services, however you will be under no obligation to accept this. If you do not accept the alternative price, we will refund the Booking Fee to you and the agreement with us for the Axioma Services will be immediately terminated. Occasionally, a Repairer may realise the intended Repair Services will be insufficient to repair the damage (e.g. where a visual inspection reveals more significant damage than revealed in photographs) and in that situation the Booking and your agreement with us for the Axioma Services will be terminated and we will refund the Booking Fee to you. We shall have no liability to you beyond refunding the Booking Fee to you in these two situations.

Cancellations and Cooling-off Period

    • Please note that we start to provide the Axioma Services as soon as you accept the quote, so we will not be able to refund the Booking Fee if you decide to cancel your agreement with us for the Axioma Services after a Booking has been made.
    • You have a 14-day cooling-off period from the date of the Booking, during which you may cancel the Booking without incurring any cancellation fees as long as the Repair Services have not been carried out. If you want to cancel the Repair Services after this 14-day cooling-off period, then any cancellation will be subject to the following cancellation fees:
      • If the Booking is cancelled within 24 hours of the scheduled repair time, the Client will be charged 20% of the Booking price.
      • If the Booking is cancelled within 12 hours of the scheduled repair time, the Client will be charged 50% of the Booking price.
      • If a Client moves a repair to another time and does not cancel, they will be required to pay the booking fee again.
      • The booking fee is outside the cooling-off period and is non-refundable.
      • Please note that once you accept our quote, we immediately begin providing Axioma Services and your booking is processed. Therefore, if you choose to cancel your agreement with us for the Repair Services after a booking has been confirmed, the booking fee cannot be refunded. This policy applies even before the 14-day cooling-off period, during which you have the option to cancel the Repair Service without any cancellation fees, provided the Repair Services have not yet been performed.

Payments

  • Payments are due upon completion of the repair (unless you notify Axioma that you are unhappy with the work). If the invoice is not paid, we reserve the right to debit the funds directly from the card you left on file when paying your deposit.
  • In the event we cannot recover the money owed, we will exercise our statutory right to claim interest (at 8% over the Bank of England base rate) and compensation for debt recovery costs (£100) under the Late Payment legislation if we are not paid according to our agreed credit terms.

Termination Rights

  • Axioma reserves the right to terminate a Client’s access to the Platform or cancel a Booking in its sole discretion, including but not limited to instances of non-payment or violation of these Terms and Conditions.

Dispute Resolution

  • If a Client has a dispute with a Repairer regarding the Repair Services, they should first contact Axioma for assistance in resolving the issue.

Data Protection and Privacy

  • Axioma is committed to protecting the privacy and personal information of its Clients. By using the Platform, you agree to the collection, use, and disclosure of your personal information in accordance with Axioma’s Privacy Policy, which can be found https://axioma.co.uk/privacy-policy/.

Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.

Miscellaneous

  • If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
  • Axioma’s failure to enforce any right or provision in these Terms and Conditions will not constitute a waiver of such right or provision unless acknowledged and agreed to by Axioma in writing.
  • These Terms and Conditions constitute the entire agreement between the Client and Axioma with respect to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the Client and Axioma with respect to the Platform and Repair Services.
  • Any notices or other communications provided by Axioma under these Terms and Conditions, including those regarding modifications to these Terms and Conditions, will be given by posting to the Platform, through email, or by any other means deemed appropriate by Axioma.
  • The Client may not assign their rights or obligations under these Terms and Conditions without the prior written consent of Axioma. Axioma may assign its rights and obligations under these Terms and Conditions at any time without notice to the Client.
  • All intellectual property rights in the Platform and the Axioma Services remain owned by or validly licensed to Axioma.
