1. “Repair Services” means any repair (including parts), and inspection services provided by a Repairer under a Booking;
2. “Booking Request” means a request from you made by means of the Axioma website, for the supply of Repair Services;
3. “Booking” means a contract for the provision of Repair Services entered into between you and the Repairer by means of the Axioma service;
4. “Charges” means the charges payable in respect of parts and labour under a Booking;
5. “Repairer” means a provider of Repairer Services, independent of Axioma Europe Ltd, which promotes its Services by means of Axioma;
6. “Body Shop Listing” means a listing in the Platform setting out a description of the Body Shop and reviews provided in respect of the Body Shop by other users of the Platform;
Terms and Conditions for Use of the Platform
A) We require all Repairers to provide a lifetime warranty on the repairs as set out below in clause B.
B) All work booked through Axioma comes with a lifetime guarantee on parts and labour. All repair services under a booking made on Axioma, including all parts supplied, must be free from defects in (i) materials (i.e. that the parts replaced in the performance of the auto services are not defective and capable of performing as expected under normal usage conditions) and (ii) workmanship (i.e. that the Repair Services were performed with a reasonable level of skill and care).
C) The repair (including parts), are provided by the Repairer booked by means of the Axioma. Not by Axioma. Our role and responsibility is limited to enlisting the services of the Repairer (and related pricing information), and arranging bookings and collecting payment on behalf of the independent Repairers who use us to connect with customers. We cannot be responsible for the actions or failures of any Repairer with whom a Booking is made, nor any repair (including parts), diagnostic and inspection services they provide.
D) The Repairers are not our employees or workers. We have no involvement in the provision of the Repair Services.
E) By Accepting our quote, a binding contract is created between you and the Repairer for delivery of the Repair Services in exchange for payment of the Charges.
F) Billing will be handled by Axioma through credit (debit) card / Paypal or Bank Transfer.
Obligations of Axioma
I) Axioma is responsible for arranging bookings and collecting payments.
J) Axioma will provide regular updates on the status of the repairs being carried out by the Body Shop to the Client, including proactively notifying the Client for any delays on the work being carried out with respect to the agreed Timeframe.
In consideration of the significant time, effort and investment expended in enrolling Repairers in the Axioma network and finding Clients for Repairers, the Client agrees that during the period over which it provides any Repair Work and for twelve (12) months after any Repair Services are completed with an Axioma Repairers, Clients will not (i) directly or indirectly encourage or solicit any Body Shop of Axioma to adversely alter their engagement with Axioma for any reason, or (ii) other than providing the Repair Work pursuant to this Agreement, enter into a service relationship with or otherwise engage with or solicit services for any Repairer to whom Client was introduced or referred to in connection with this Agreement (whether or not Work was performed) without first notifying Axioma in writing of such engagement and obtaining Axioma’s prior written consent.
We understand that schedules change and you may need to change the time of a body repair. If you cancel the booking you will lose your 20% deposit. If you cancel within 24 hours of the scheduled time we will charge 50% of the booking price. Cancellations within 12 hours of the booking time will be charged at 100%. If you move a repair 24 hours before the due date to another time (within 30 days) and do not cancel, you will be charged a 10% fee. Changing the time 12 hours before a booking will result in a 50% fee. The reason; Your body repair specialist will have booked out time for you and your vehicle in their working day and they need to make a living.
We will exercise our statutory right to claim interest (at 8% over the Bank of England base rate) and compensation for debt recovery costs (£100) under the Late Payment legislation if we are not paid according to our agreed credit terms.
